Supreme Court of India Directs Mandatory Deemed Forest Status and Demarcation for Rajasthan Orans
A three-judge bench of the Supreme Court has ruled that traditional sacred groves (Orans) must be recognized as deemed forests regardless of size or tree density, protecting thousands of hectares from industrial diversion.
New Delhi: In a historic affirmation of community-conserved sacred geography, the Supreme Court of India has directed the State of Rajasthan and the Union Ministry of Environment, Forest and Climate Change to initiate comprehensive satellite and ground demarcation of all Orans (sacred groves) and record them as "Deemed Forests".
The bench, comprising Justices B.R. Gavai, S.V.N. Bhatti, and Sandeep Mehta, pronounced the order in continuing hearings on ecological conservation. The Court firmly rejected bureaucratic size thresholds (such as the 5-hectare requirement) previously used by state committees to exclude arid and community-held groves.
The Court held that Orans are living repositories of indigenous desert ecology, serving as natural water recharge basins, grazing pastures for native livestock, and critical breeding sanctuaries for endangered desert fauna including the Great Indian Bustard (Godawan), Chinkara, and Desert Fox. The bench further highlighted Section 36-C of the Wild Life (Protection) Act, 1972, enabling the declaration of community reserves that protect grassroots custodial stewardship.
